Article 1 – Who we are and definitions

1. D&A Begeleiding is the shared name under which three independent tutors work together to make booking tutoring sessions easier. D&A Begeleiding is not a registered company.

2. Tutor: one of the tutors working under the name D&A Begeleiding who teaches the session.

3. Student: the person who receives the tutoring.

4. Booker: the person who books and pays for a tutoring session. This can be the student's parent, grandparent, guardian or another adult, or the student with the approval of a parent or guardian.

5. Session: a one-on-one tutoring session for a service and length chosen by the booker.

6. Service: one of the types of tutoring offered by D&A Begeleiding, as described on the website.
    

Article 2 – Scope

1. These terms apply to every booking of a tutoring session with D&A Begeleiding.

2. By booking a session, the booker accepts these terms.

3. Other arrangements apply only if a tutor has confirmed them in writing (including by email or WhatsApp).

4. If any provision of these terms is invalid, the remaining provisions stay in force.
    

Article 3 – Booking

1. Sessions can be booked through the website, by email, phone or WhatsApp.

2. A booking is final once a tutor has confirmed it.

3. If the student is under 18 and makes the booking, a parent or guardian must approve it. A tutor may ask for this approval before confirming.

4. When booking, the booker chooses the service, the session length, the date and time, and the location (see Article 4).

5. D&A Begeleiding tutors primary school students (grades 1–6) and secondary school students (years 1–3 of MAVO, HAVO and VWO).

6. D&A Begeleiding may decline a booking, for example if the requested help falls outside what we offer or no tutor is available.
    

Article 4 – Services, session length and locations

1. D&A Begeleiding offers several services. The content and price of each service are listed on the website.

2. The booker chooses the session length when booking.

3. On weekdays, sessions take place at the Biblioteca Nacional Aruba.

4. On weekends, the location is agreed between the booker and the tutor and can be anywhere in Aruba.

5. Travel to and from the location is the responsibility of the booker and the student.

6. If the student arrives late, the session still ends at the agreed time and the full session is charged. If the tutor arrives late, the missed time is made up or deducted from the fee.
    

Article 5 – Fees and payment

1. The fee depends on the service chosen and the session length. Current fees are listed on the website.

2. Payment is due as soon as the session is over.

3. If a session is not paid, the tutor may refuse to schedule further sessions until payment is received.

4. D&A Begeleiding may change its fees at any time, with prior notice on the website or to the booker. Sessions already booked keep the fee that applied at the time of booking.
    

Article 6 – Cancelling and rescheduling

1. The booker can cancel or reschedule a session free of charge up to 6 hours before it starts.

2. Later cancellations and no-shows are charged in full.

3. If the student falls ill suddenly and this is reported before the session starts, the tutor may, at their discretion, reschedule the session free of charge.

4. If a tutor has to cancel, the session is rescheduled at no extra cost, or another tutor of D&A Begeleiding takes over.

5. Cancellations are made by email, phone or WhatsApp.
    

Article 7 – Conduct during sessions

1. The student arrives on time and brings the required materials (books, notebooks, homework, test material).

2. The booker shares information that helps the tutoring, such as test dates or points the student struggles with.

3. The student treats the tutor with respect and follows the house rules of the location.

4. A tutor may end a session early in case of inappropriate behaviour. The full session is then charged.
    

Article 8 – Supervision

1. Sessions take place in public or semi-public locations or at an agreed location.

2. The student's parents or guardians remain responsible for the student while travelling to and from the session and before and after the session.

3. Tutors do not provide childcare. After the session, the student must be picked up or, with the permission of a parent or guardian, leave independently.
    

Article 9 – Damage and liability

1. Tutors commit to their best efforts for the student's progress but do not guarantee specific grades, test results or promotion to the next year.

2. Any damage caused by the student is the responsibility of the student's parents or guardians.

3. D&A Begeleiding and its tutors are not liable for loss of or damage to the student's belongings during or around a session.

4. The liability of D&A Begeleiding and its tutors is in all cases limited to the amount paid for the tutoring session concerned, except in case of intent or gross negligence.

5. Materials provided by a tutor are for the student's personal use only and may not be distributed or sold.
    

Article 10 – Privacy

1. Tutors use the personal data of the booker and student only to schedule and teach sessions and to handle payment.

2. Tutors keep what they learn about the student and the family during sessions confidential.

3. Tutors do not take photos or videos of students.
    

Article 11 – Complaints

1. Complaints should preferably be submitted within 14 days of the session concerned, to dna.begeleiding@gmail.com

2. D&A Begeleiding responds within 14 days.
    

Article 12 – Changes and governing law

1. D&A Begeleiding may update these terms. The latest version is always available on dna-begeleiding.com. Sessions already booked fall under the terms that applied at the time of booking.

2. These terms and all bookings are governed by the laws of Aruba.

3. Disputes that cannot be resolved between the parties are submitted to the Court of First Instance of Aruba (Gerecht in Eerste Aanleg van Aruba).
